It was not immediately clear why Franklin County Municipal Judge Steven B. Hayes took himself off the case. He could not be reached for comment late Thursday. The case was reassigned to, Judge Mark S. Froehlich, the clerk's office said.

Clarett pleaded innocent to a misdemeanor falsification charge, which has a maximum penalty of six months in jail and a $1,000 fine. He was charged with filing an exaggerated theft report with campus police in April after a dealership's car he was borrowing was broken into. The police report said cash and stereo equipment worth' thousands of dollars was taken. Clarett's lawyers filed a request for Hayes' removal on Sept. 24.

Cases are assigned to judges at random. Franklin County Common Pleas Judge David W. Fais denied the affidavit of disqualification on Oct. 2, saying the motion by Clarett's attorneys was "without merit." Hayes said at the time that he could not think of a reason why he couldn't be an impartial judge in the case. BASEBALL Clemens, Pettitte file for free agency Roger Clemens and Andy Pettitte filed for free, agency Thursday, removing the two pitchers from the New York Yankees' roster.

Clemens has said he is retiring. By filing, the 41-year-old right-hander gives himself the option of negotiating with all 30 teams if he changes his mind. Pettitte, one of the top pitchers in this year's free-agent group, has not yet started negotiations for a' new contract. The Yankees repeatedly have said they hope to re-sign him and he has said it would be hard for him to imagine pitching for another team. Dernell Stenson wasn't even supposed to be playing, in the Arizona Fall League.

The promising young Cincinnati Reds outfielder was a late addition when Wily Mo Pena was granted his wish to play winter ball in the Dominican Republic. Early Wednesday, Stenson's body was found in a street in a residential neighborhood in the Phoenix suburb of Chandler. The 25-year-old prospect had been shot, then run over and apparently dragged some distance by his own SUV, police said. A man found driving Stenson's SUV two hours later, 10 miles away in Mesa, was arrested and booked on a charge of possession of stolen property. Chandler police called the man, Kevin Riddle, 43, an "investigative lead." Police said Riddle was a transient.

Stenson was claimed by the Reds off waivers from the Boston Red Sox on Feb. 25. Louis Charlotte and Saint Louis were invited to join the Atlantic 10 Conference on Thursday in an expansion that would boost the league to 14 teams. Charlotte and Saint Louis are currently in Conference USA, which already will lose Cincinnati, Louisville, South Florida, Marquette and DePaul to the Big East in 2005. While neither school announced a decision, Atlantic 10 commissioner Linda Bruno said the offers would not have been extended unless the conference knew that the schools would accept. The Atlantic 10 already has 12 members: Dayton, Duquesne, Fordham, George Washington, La Salle, Massachusetts, Rhode Island, Richmond, St. Bonaventure, Saint Joseph's, Temple and Xa-vier.

Charlotte and Saint Louis will add to an already strong basketball league. The Billikens made the NCAA tournament four times in the last 10 years and Charlotte advanced in 2000.
